Terms of Service

These terms apply to Polyphasic Developers websites, services, software, mobile apps, web apps, and any other applications created, published, operated, or maintained by the PD team unless a product-specific agreement says otherwise.

Agreement to These Terms

These Terms of Service and End User License Agreement ("Terms") govern your access to and use of websites, apps, software, documentation, content, support, and related services made available by Polyphasic Developers, PolyphasicDevs, or the PD team ("PD," "we," "us," or "our").

By accessing a PD website, downloading or using a PD app, creating an account, starting a trial, making a purchase, or otherwise using any PD product or service, you agree to these Terms. If you do not agree, do not use the relevant website, app, product, or service.

Scope

These Terms apply to:

  • The Polyphasic Developers website and related public pages
  • Mobile, desktop, and web applications created by the PD team
  • Free, paid, beta, preview, trial, subscription, and lifetime-access versions of PD apps
  • Support, documentation, updates, cloud features, integrations, exports, and related services supplied with PD apps

If a specific PD app, client project, statement of work, order form, privacy policy, or written agreement includes different terms, those specific terms control only for the product or work they cover. All other use remains subject to these Terms.

Eligibility and Accounts

You must be legally capable of entering into a binding agreement in your jurisdiction to use PD products and services. If you use a PD product on behalf of a company, organisation, or another person, you represent that you have authority to bind that party to these Terms.

You are responsible for maintaining the confidentiality of any account credentials, device access, API keys, workspace invitations, purchase credentials, or authentication methods used with PD products. You are responsible for activity under your account unless caused by our breach of these Terms.

Website Use

PD websites are provided for general information about our products, services, work, and contact options. Website content does not create a client, supplier, employment, partnership, fiduciary, or professional advisory relationship by itself.

Any proposal, estimate, project brief, discovery call, implementation plan, delivery schedule, or commercial arrangement is subject to separate written agreement between the relevant parties.

App EULA: License Grant

PD apps are licensed, not sold. Subject to these Terms and your compliance with applicable platform rules, PD grants you a limited, non-exclusive, non-transferable, revocable license to download, install, access, and use each PD app for your personal or internal business purposes on devices you own or control.

For apps distributed through the Apple App Store, this license is limited to use on Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and Conditions, including permitted Family Sharing, volume purchasing, or similar Apple-approved access where applicable.

For apps distributed through Google Play, Microsoft Store, direct download, TestFlight, beta channels, enterprise distribution, or another authorised platform, your use is also subject to the applicable platform, store, beta, or device rules.

PD reserves all rights not expressly granted to you.

App Store Terms

Where a PD app is made available through the Apple App Store, you and PD acknowledge that:

  • These Terms are between you and PD only, not Apple
  • PD, not Apple, is solely responsible for the app and its content
  • Apple has no obligation to provide maintenance or support for the app
  • Apple is not responsible for addressing claims by you or a third party relating to the app, including product liability claims, legal or regulatory claims, consumer protection claims, or intellectual property claims
  • If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, as required by its policies and applicable law
  • You represent that you are not located in a country or region subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on any United States government list of prohibited or restricted parties
  • Apple and its subsidiaries are third-party beneficiaries of these Terms for Apple-distributed apps and may enforce these Terms against you as such

Permitted Use and Restrictions

You agree to use PD products only in accordance with these Terms, applicable law, applicable platform rules, and any documentation or usage limits we provide.

You must not:

  • Copy, modify, translate, sell, lease, sublicense, distribute, or create derivative works from PD software except as expressly allowed by law or written permission
  • Reverse engineer, decompile, disassemble, or attempt to extract source code except where applicable law prohibits that restriction
  • Bypass, disable, or interfere with licensing, entitlement, authentication, billing, security, rate-limit, or access-control systems
  • Use PD products to violate privacy, intellectual property, consumer protection, security, export-control, or other applicable laws
  • Upload, process, transmit, or share unlawful, harmful, infringing, abusive, deceptive, or malicious material
  • Interfere with the availability, performance, integrity, or security of PD products or third-party services connected to them

App Features, Data, and Permissions

PD apps may include local storage, cloud services, device permissions, notifications, analytics, health or productivity features, exports, AI-assisted features, integrations, subscriptions, or other functionality. Features vary by product and may change over time.

You are responsible for the data, files, prompts, content, credentials, settings, integrations, exports, and permissions you choose to use with PD products. Review exported or generated content before relying on it or sharing it with others.

Where an app requests access to device data, contacts, calendars, photos, files, health data, location, microphone, camera, notifications, or another permission, you may withhold or revoke that permission through your device or platform settings. Some features may not work without required permissions.

Purchases, Subscriptions, and Trials

PD products may offer free features, paid downloads, one-time purchases, in-app purchases, subscriptions, trials, credits, usage-based features, or lifetime-access options. Prices, feature availability, billing periods, trials, and promotions may change over time.

Where purchases are made through an app store or payment platform, billing, renewal, cancellation, refunds, chargebacks, taxes, and payment disputes may be handled by that platform under its own terms and policies. You are responsible for managing subscriptions through the account or platform used to purchase them.

Unless required by law or stated in product-specific terms, fees are non-refundable once charged.

Client Work and Bespoke Software

Custom software, consulting, support retainers, agency work, implementation services, AI development, hosting, maintenance, or other client engagements are governed by the relevant written proposal, statement of work, master services agreement, purchase order, or signed contract.

If there is a conflict between these Terms and a signed client agreement, the signed client agreement controls for that engagement.

Intellectual Property

PD products, websites, apps, software, source code, object code, designs, user interfaces, workflows, branding, logos, text, graphics, documentation, and other materials are owned by PD or its licensors and are protected by intellectual property and other laws.

You retain ownership of content, data, and materials you provide to PD products, subject to any rights needed for us to operate, secure, support, improve, and provide the relevant product or service.

If you send suggestions, feedback, issue reports, ideas, or improvement requests, you grant PD a perpetual, worldwide, royalty-free right to use that feedback without restriction or obligation to you.

Privacy

Your use of PD products is subject to the applicable privacy policy. The main PD website privacy policy is available at /privacy-policy/. Some apps may have their own privacy policy or product-specific privacy information.

Third-Party Services and Open Source

PD products may integrate with third-party platforms, APIs, app stores, payment processors, AI services, analytics providers, cloud providers, operating systems, device features, or open-source software. Third-party services are governed by their own terms and privacy notices.

PD is not responsible for third-party services, outages, policy changes, data handling, pricing, model behaviour, app store decisions, or platform restrictions outside our reasonable control.

Updates, Availability, and Support

We may add, modify, suspend, remove, or discontinue features, products, services, pricing, integrations, support channels, or compatibility at any time. Some features may require updates, an active subscription, compatible hardware, a supported operating system, internet access, or third-party service availability.

We aim to provide useful and reliable products, but we do not guarantee uninterrupted availability, error-free operation, backwards compatibility, or permanent support for any specific feature, device, operating system, integration, or product version.

Disclaimers

To the maximum extent permitted by law, PD products and services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or reliability.

Unless a product-specific agreement says otherwise, PD products do not provide legal, financial, medical, tax, security, regulatory, emergency, or other professional advice. You are responsible for checking outputs, exports, recommendations, AI-generated content, calculations, and automated actions before relying on them.

Limitation of Liability

To the maximum extent permitted by law, PD and its directors, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, anticipated savings, or reputation arising out of or related to your use of PD products or services.

To the maximum extent permitted by law, PD's total liability for any claim arising out of or related to these Terms or your use of PD products will not exceed the greater of: (a) the amount you paid to PD for the relevant product or service in the 12 months before the event giving rise to the claim; or (b) GBP 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Indemnity

To the extent permitted by law, you agree to indemnify and hold PD harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your misuse of PD products, violation of these Terms, violation of law, infringement of third-party rights, or content and data you submit, process, export, or share through PD products.

Termination

You may stop using PD products at any time. We may suspend or terminate access to a product, account, license, service, beta, or feature if we reasonably believe you have violated these Terms, created risk for PD or others, failed to pay amounts due, breached platform rules, or if continued operation is no longer practical.

On termination, your license to use the affected product or service ends. Sections that by their nature should survive termination will continue to apply, including intellectual property, payment obligations, disclaimers, limitation of liability, indemnity, governing law, and dispute provisions.

Export Control and Legal Compliance

You are responsible for complying with applicable laws, including export-control, sanctions, privacy, consumer protection, data protection, intellectual property, and platform rules. You must not use PD products where prohibited by law or to support unlawful activity.

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles, except where applicable consumer protection or mandatory local law requires otherwise.

Where permitted by law, disputes relating to these Terms or PD products will be handled by the courts of England and Wales.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice where appropriate. Your continued use of PD products after updated Terms become effective means you accept the updated Terms.
