Forma Terms of Use

These Terms of Use ("Terms") govern your use of the Forma mobile application and related services made available by PolyphasicDevs ("we," "us," or "our"). By downloading, accessing, or using Forma, you agree to these Terms.

Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use Forma. If you use Forma on behalf of another person or entity, you represent that you have authority to bind them to these Terms.

License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Forma for your personal, non-commercial use on devices you own or control, in accordance with Apple’s App Store rules and these Terms.

We reserve all rights not expressly granted to you.

App Features

Forma is a health and fitness app that may:

• Read data from Apple Health with your permission
• Generate analytics, trends, summaries, records, goals, and insights
• Export data to locations you choose
• Offer optional paid premium features

Features may change over time. We may add, modify, suspend, or remove features at any time.

Health Disclaimer

Forma is provided for informational and general wellness purposes only. It is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services.

You should not rely on Forma as a substitute for professional medical judgment. Always seek the advice of a qualified healthcare professional regarding medical questions or before making decisions based on health information.

If you believe you are experiencing a medical emergency, call emergency services immediately.

Your Responsibilities

You agree to:

• Provide any permissions the app needs only if you are comfortable doing so
• Review your exported data before sharing it with others
• Keep your device and storage locations reasonably secure
• Use Forma only in compliance with applicable law and Apple’s platform rules

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code except where prohibited by law from restricting that activity
• Use Forma to violate another person’s rights
• Interfere with the operation or security of the app
• Misrepresent subscription status, purchases, or entitlement access

Subscriptions and Purchases

Forma may offer paid products, including recurring subscriptions and non-consumable purchases such as lifetime access.

If you purchase through Apple:

• Payment is charged by Apple through your App Store account
• Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions through your Apple account settings
• Refunds and billing issues are handled by Apple under Apple’s policies

Pricing, billing periods, available plans, and trial offers, if any, may change. The terms presented in the App Store at the time of purchase control for that purchase.

Availability

We do not guarantee that Forma will always be available, error-free, or compatible with every device, operating system version, or configuration.

We may release updates, patches, or new versions at any time, and some features may require you to install updates to continue using them properly.

Data and Exports

You are responsible for the data you choose to export, copy, store, or share using Forma. Once exported to a location you control, the security and handling of those files are your responsibility and the responsibility of any storage provider you use.

Intellectual Property

Forma, including its software, design, branding, text, graphics, and other content provided by us, is protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works from Forma except as allowed by law or by our written permission.

Privacy

Your use of Forma is also subject to our Privacy Policy.

Disclaimer of Warranties

To the maximum extent permitted by law, Forma is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• Forma will meet your requirements
• Forma will be uninterrupted, timely, secure, or error-free
• Any analytics, summaries, or insights will be accurate, complete, or suitable for your specific circumstances

Limitation of Liability

To the maximum extent permitted by law, PolyphasicDevs and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of Forma.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to Forma will not exceed the amount you paid, if any, for Forma in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

These Terms remain in effect until terminated. You may stop using Forma at any time by removing the app from your device.

We may suspend or terminate your access to Forma if we reasonably believe you violated these Terms or if continued operation of the app is no longer practical.

Governing Law

These Terms are governed by the laws of the jurisdiction where PolyphasicDevs is established, without regard to conflict of laws principles, except where applicable law requires otherwise.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice where appropriate.
